Listing & Selling Offences

Listing and Selling Offences

The responsibility for the content of each listing rests with the seller. Listings displaying the following attributes may be removed at the discretion of Tazbar staff and the listing member will receive an official warning which may lead to their removal from the website and any outstanding fees charged to their registered credit card. Repeat offenders may be suspended or suitable action taken against their account.

  • Selling Fee Evasion :

Listing items with very low selling prices but mandatory shipping fees that are excessive is not allowed.

  • Excessive Postage and packing charges :

Listings with excessive and unreasonable postage and packaging charges are not allowed.

  • Copied listings :

Listings with text or images copied from another user's listings or anywhere else on the internet are not allowed and may be removed at the discretion of Tazbar staff.

  • Keyword spamming:

To enable Tazbar to be a safe and fair trading environment we ask that all descriptions and titles are relevant to the item being sold. The use of misleading words to entice a member to the listing only to find that the listing does not contain the content that they expected is not allowed. Use of irrelevant key words and brand names is not allowed.

For example : "Honda CB250 motorcycle – not Suzuki Kawasaki." This type of title is not allowed and listings will be removed .The title : "Chrome Zippo type lighter" or "Tiffany style bracelet" are also not allowed for the same reason. If the item is not a Zippo lighter the brand name cannot be used to promote the item that is not in fact a Zippo lighter.

  • Deceptive or inaccurate item description:

When describing an item, or items, or services, members must provide very accurate, honest descriptions. Should items be faulty or damaged, faults or damage must be entered with the description. If possible on damaged goods members should show images of the damaged area. Returned goods or factory seconds must be clearly defined as such within the auction description. Any listing that contains factory or store returns or any faulty or sub standard item must clearly state that the item is a return or faulty item. By doing this you are being fair to the buying member and this will avoid disappointment and dispute issues, and/or possible prosecution. Item condition should also be described as accurately as possible and should not be omitted. Sellers must clearly state to the best of their knowledge the potential faults with the item. Please use the Distance Selling Rules as a basic guideline for what is expected from both partiy's i.e buyers and sellers when concluding an online sale.

  • Incorrect Categorisation:

It is crucial that your listing is put into the correct category. This will help your trading partners to find you quickly. There are over 4000 categories throughout the Tazbar. Please contact us at categories@tazbar.net if you have any category suggestions or queries.Listings placed in the wrong category may be ended early by Tazbar. In this instance an email will be sent to the seller stating that the listing is incorrectly categorised and any listing upgrade fees charged by Tazbar will be credited to the members account. The seller can then choose to re-list the item in the correct category.

It is also important that items are not listed in the incorrect section of the website. Auctions must not be placed in the Wanted section and vice versa.

  • Violation of Rules for Multiple item listings:
    • When there is more than one item in a single transaction it is referred to as a “Lot”. Multiple listings must be for lots and not multiple single items.
    • Wholesale listings must contain at least 5 individual items per auction lot. For example an auction that contains 5 kettles to be sold as one lot of 5 is accepted as wholesale. For example a multiple listing with 10 lots of 5 vases is accepted in this category however a multiple listing of 50 of 1 vase is not accepted and must go into the appropriate retail category.

  • Too many identical / duplicate listings:

Tazbar allows members to list multiple items on a single “Instant Purchase” auction. However the goods must be identical and the seller must have sufficient stock to supply all items listed .Duplicate listings of an item for sellers who have more than one of the same item in stock and wish to place more than one listing is allowed. The maximum limit is 10 identical listings. The reason a seller may want to list duplicate listings rather than a single multiple item listing is that duplicate listings will end (if stagger timed) at different times therefore giving a broader exposure to the sellers goods.Duplicate item listings that exceed 10 may be ended early by Tazbar. In this instance an email will be sent to the seller stating that the reason for removal and any listing upgrade fees charged by Tazbar will be credited to the sellers account.

  • Asking the buyer to pay surcharges after purchasing the item:
    • Surcharges are extra charges added to the transaction after the sale, intended to cover charges incurred by the seller in relation to the sale or acceptance of payment. Surcharges must be clearly defined and shown. The following surcharges are allowed in listings:
      • Postage and packaging charges. This must be clearly stated on the auction description. Only reasonable fees may be charged and this can not be a % of the final item price.
      • Escrow: If a buyer wishes to use an escrow service to pay for an item then the buyer is responsible for the escrow service fees. This is providing the seller agrees to use an escrow service.
      • Currency exchange fees: A seller has the right to charge a reasonable currency exchange fee if they choose to trade in a foreign currency providing this has been agreed in advance with the buyer.

    • The following surcharges are not allowed in a listing:
      • They must be calculated into the selling price.
      • Surcharges are not allowed to be added to cover fees incurred by the seller when accepting the following:
      • Electronic money payment services such as Paypal, Nochex etc.
      • Cheques, money orders, postal orders.
      • Credit and debit card fees
      • Tazbar listing fees
      • In the case of electronic money payment transfers such as, but not limited to, Paypal, Nochex etc… the law states that these payments are classified as electronic money payments and not a credit card payment. Even though a credit or debit card may have been used, this in effect buys an electronic money credit that is used to fund the transaction. As this is the case with these examples surcharging is restricted by English law.
  • Adult or Offensive title, image or description:

The use of profanity, swear words etc.. is not allowed on the main site or forums , any listings found to contain such words or phrases will be removed and the listing member will receive an official warning.Tazbar requests that adult related items and adverts are not listed on the website. This includes but is not limited to the following :

    • Marital aids
    • Images of an adult nature
    • Adult publications showing nudity or sexual content.
    • Adult films containing explicit nudity or sexual content.
    • Listings intended to make contact with others for sexual purpose.
    • Any listings found that are deemed to be of adult nature will be removed.
    • Nudity
  • Counterfeit items and Unauthorised copies:

The sale of products that include images, names or signatures of other people that are not authorized or manufactured by that person are prohibited for sale. For example a scanned copy of an original photo of a pop star. The original may have been authorized but the copy is not. This is the same as bootlegging. Also a photo that you may have taken of a movie star. You may have had the right to take the photo but you don't have the right to sell the photo on the strength of the name of the movie star. The same applies to names and signatures. It is prohibited to sell any copy or bootleg items. Items such as, but not limited to clothing, footwear, handbags, watches etc that are not made by the original marked maker. Items including, but not limited to, CD, DVD, MP3, Video, VHS recordings, Video and PC software games and titles that are unauthorised copies are also prohibited. Any items that are suspected to be non authorized copies are prohibited.

  • Inappropriate Direct choice item:

A seller can give the buyer a choice on all aspects of an item in a listing that DO NOT affect the price of the item or incur additional payment eg. The choices allowed are : colour, flavour, style etc. Size, weight, quantity cannot be specified by the buyer via email as they may affect the price of the item .For example if you are selling t-shirts, the size will not normally affect the price of the item and therefore it is allowed. If you are selling cakes, the size of the cake will normally affect the price and therefore direct choice is not allowed. In this instance, the seller will have to create separate listings for different size cakes. The general rule to remember is that the seller can let the buyer select anything after the listing ends that doesn't affect the price of the listed item or incur additional payment.

  • Inclusion of contact details: Inclusion of personal details and contact information is not allowed. Any form of contact information may not be included in wanted and selling auction listing descriptions, titles or user names. This includes but is not limited to.:-

Email address, Residential or business address, Telephone numbers, Fax number etc.

  • Non delivered Item: An item already sold to a user cannot be re-listed unless the dispute with the buyer (if any) is resolved.

  • Off site sales:

Negotiating deals outside of Tazbar is against Tazbar rules . All pre-sale email traffic between buyers and sellers is visible on the auction listing page to help investigate direct selling.Such cases will be investigated and offenders may be suspended.
