Acceptance of terms.

Please read these Terms and Conditions ( “Terms” ) carefully as use of this service on the worldwide web directed by the URL www.TAZBAR.com ( “the Website” ) constitutes your acceptance of these Terms. Tazbar.com Ltd reserves the right to update the Terms at any time by displaying amended Terms on the Website. You will be deemed to have agreed to the amended Terms when you next use this Website following any amendment. The Website Disclaimer and Privacy Policy are part of the Terms of use of this Website.

Your use of this website.

Tazbar.com Limited admits you to this Website in order to provide you the opportunity to buy or sell goods and services, display contact details or communicate in the chat room ( the "Goods and Services" ). You will not use this Website for any unlawful purpose including, without limitation, posting inaccurate, or false information about yourself or Goods and Services you may wish to sell on this Website or, posting material containing any virus or interfere with the operation of this Website or attempt to decipher, or modify any of the software, coding or information comprised in this Website.

Tazbar.com Limited in its sole discretion shall determine your compliance with the above and shall have the right to prevent you from using the Website and/or to delete from the Website without prior notice to you any material that deems not to comply or to be objectionable for any reason.

Tazbar.com Limited makes no claims, promises or guarantees about the accuracy, completeness, or adequacy of the contents of this Website and expressly disclaims liability for errors and omissions in the contents of this Website.

No warranty of any kind, implied, expressed or statutory, including but not limited to the warranties of non-infringement – infringement of third party rights, title, merchantability, fitness for a particular purpose and freedom from computer virus, is given with respect to the contents of this Website.

Tazbar.com Limited particularly does not give any warranty or other assurance as to the accuracy of listings, advertisements and material appearing on this Website.

Tazbar.com Limited expressly disclaims liability for errors and omissions in the contents of this Website. Access to the Website may be interrupted, restricted or delayed for any reason.

You acknowledge that any reliance on material found on this Website will be at your own risk.

To the fullest extent permissible by law Tazbar.com Limited disclaims all responsibility for any damages or losses including without limitation, financial loss, loss of profits or other consequential losses, arising from the use of this Website or any material appearing on it.

You may be offered a number of automatic links to other Websites which may interest you. Tazbar.com Limited accept no responsibility for or liability in respect of the content of those Websites. The use of any automatic links to these Websites is entirely at your own risk.

The role of Tazbar.com Limited

The purpose of Tazbar is to offer a venue for person to person trading of services, contacts and goods. As such it does not take possession of any goods offered on the auction listings. We do not get involved in transactions between buyers and sellers and do not review all of the items and services listed on the site. Therefore we do not control the legality, safety or quality of products or services offered by its members. No association between the goods and services offered and the site can be made and no validity or legality can be assumed simply because an item or service is listed on the site. Tazbar is not an auctioneer. As a venue we do not take any responsibility for the completion of any transactions that take place within the site listings. All responsibility is held by the member to act legally and lawfully.

Legal Liability between trading partners

If an incident occurs where any type of claim or action is taking place between yourself and another user arising from the use of the site you agree that such action is between yourself and the other user. No recourse will be taken against Tazbar or associated companies, directors, or staff for any claims of and not limited to loss, damages, costs, legal fees, liability.

Membership Age Restrictions .

You agree that you are 16 years of age or older. Tazbar does not accept members under the age of 16. Should you wish to allow a person under this age to view the listings within the main site it must be done so under the supervision of a parent or guardian over the age of 16 years.

User Name and Passwords

When joining the website you will choose a username and password. The use of this username and account is your responsibility. You ensure that passwords are kept safe and not passed on to others. Your username, password and account are to be used by yourself only. It can not be sold or given to another person.

The following restrictions are enforced on usernames:

• Usernames cannot consist of offensive words
• Usernames cannot be web site addresses of sites promoting sales outside of Tazbar or of sites containing offensive material

Illegal Items.

Tazbar has a list of prohibited items. You must not offer, sell or bid on these items. We offer a service to report illegal items and this link appears on the toolbar that is constantly on the left hand side of the screen throughout Tazbar. If you discover a prohibited item please report it immediately. Tazbar will not accept any responsibility or obligation to protect you from unsafe items. Listing of any item on Tazbar does not mean it is either safe, or legal.

Member Information.

Tazbar attempts to offer a secure website and along with its merchant banking partners uses various techniques to verify its members. However we do not confirm the claimed identity or integrity of any member. The feedback system offers a way to check a member's history of trading . Please use this to help form an opinion of your trading partner. You agree that by using this website you understand that Tazbar cannot be held responsible for its member's honesty and integrity. The UK has strict laws relating to holding personal data, your information will be securely held to conform to these standards (Data Protection).

Feedback History

An important part of Tazbar is its Member Feedback History. Please use this facility to check out your trading partners. Do not abuse the feedback system. Before leaving a negative feedback you must ensure that you have explored every avenue to resolve a dispute. Tazbar will remove members that have a feedback rating of -4.

General.

By joining Tazbar you agree that you are responsible for all of the information that you give us when registering and placing listings on the website.

You must not give false information.

You must remain respectful to all other members.

You must be honest at all times.

Do not use profanity within any text or show any obscene or child pornographic images.

You must not be offensive or defamatory in any way.

You must not break copyright rules or breach privacy and other rights.

You must not trade in illegal or stolen goods.

You must not list a prohibited item

You must abide by all local laws.

You must not include personal contact information in a listing.

You must not include external links except those accepted in our Listings Policy.

You must not include directions to find external links elsewhere either contained on the Tazbar website or offsite.

You must not interfere with or cause damage to the workings of the website.

You must not use any robot, scraper or spider to access the website without permission.

Listings

Tazbar reserves the right to remove a listing at any time. By joining Tazbar you agree to abide by the following rules.

Selling

You must be legally allowed to sell the item you are offering, by a combination of ownership, permission of the owner, legality of the item and acceptance of our prohibited items list. It is the seller's responsibility to ensure that the item is legal to be sold to the destination that it is being sent to and sold from. You must give a full and true description of the item. Listings must not contain any personal contact information. Once a listing goes live on the website any listing fees will be deemed chargeable and remain unless Tazbar finds reason to withdraw the listing. Once you have started a live listing you agree that you do not have the rights to a refund under the Distance Selling Regulations Act 2000 or similar local acts.

You agree never to include any personal contact information in any listings except classified or service adverts.

A seller is committed to selling the item as soon as a bid is either purchased via “Buy Now” “Sealed bids” or an over reserve bid on a standard auction.

You must not bid on an item that you are selling yourself, or ask others to bid on an item that you are selling to falsely increase the price. Tazbar will investigate bidding patterns in such cases.

Buying

When you make an over reserve price bid, “Buy Now” bid or place a successful “Sealed Bid” you are legally bound to complete the transaction with the seller. The conditions of the sale are between yourself and the seller and reference should be made to their item description. You may retract bids only in very limited circumstances. As a buyer you must be in a position to fund your purchase.

You agree never to include any personal contact information in any wanted advert listings.

Service Adverts

Service adverts caters for all kinds of peoples contact and service needs. By joining Tazbar you agree that you are responsible for your actions when listing or responding to a listing in this section. Tazbar accepts no liability or responsibility for any failure in services or experiences, damages, costs or other arising from the contacts that you meet through a service advert.

Use the Members Feedback History to learn more about the other member before making email contact.

If you respond to a service advert listing in a malicious, disruptive or non relevant way this may lead to your membership being suspended.

Fees

To view and bid on items on Tazbar is FREE.

Charges apply to:

Seller's auction upgrades and reserve price fees.

Sellers final price fee.

Service Adverts.

Classified Adverts.

Membership Upgrades.


Collection of fees

In order to place a listing on Tazbar, sellers must be telephone verified. A monthly statement will be sent via email to every member who has a Tazbar account balance on the first day of each month. This will show the amount outstanding for the previous month plus any amounts carried forward, the member is then asked to proceed to their Control Panel Pay Tazbar page to make the payment in the following 7 days. The member does not need to re-enter their credit card details again unless the registered card has expired or is changed by the member. The member has the option of making intermediary payments using the checkout facilities found here also. Full details of the monthly statement including transaction fee breakdowns can also be found in the " Account" section of the control panel. The member must check their account and inform Tazbar at support@tazbar.net before the 7 day notice period expires of any discrepancies.

If a member does not make the payment the following actions will apply.

7 days from the invoice date. The user will be reminded 7 days after their invoice/statement email has been sent if payment has not been received.

14 days from the invoice date. In the event that the member hasn't paid within 14 days, a further email will be sent to the user to remind them. The user will also be informed that a 3rd and final reminder will be made in 7 days time. The user will now be restricted and unable to place or amend existing adverts. Auto-relist will be removed from any live adverts. If the user makes a voluntary payment via the control panel "Account" screen for the outstanding invoice amount, their status will return to normal.

21 days from the invoice date. The third and final reminder will take place. Users that fail to make payment by this date will be placed on "Stop". They will be emailed to remind them of their outstanding balance. All activity on the website will be suspended for the user and they will only have access to their Control Panel "Account" screen to make payments. All live listings will be stopped. Seller Galleries will be paused and membership upgrades will cease. All membership benefits will be removed. Debt collection charges of (£30GBP : $60USD :€45EUR) and an administration charge (£70GBP : $140USD :€105EUR) may be added to the users account if Tazbar choses to pursue legal action. The user will be informed that payment of the entire account including charges is now due within 7 days..

Day 28. Users that have not made payment in full by this date will be informed that legal action may take place.



Paypal and Google Checkout

Tazbar accepts voluntary payment via Paypal and Google Checkout. This can be done by going to the Control Panel and clicking on the Pay Tazbar link on the left.

Tazbar's fees are shown on the fees page which is part of the User Agreement. Tazbar reserves the right to change its fee structure at anytime and will give a minimum of 14 days notice within the news section. Tazbar may also give promotional discounts and services. These will also be shown in the news section as well as by email notification. When such promotions are announced they will apply only to the described relevant features and dates and will not be applied to any listings that are live at the time of the announcement.

All fees are payable in GBP sterling although your credit card supplier may make the exchange if your local currency is different. Tazbar will not be held responsible for any charges incurred for this exchange. When an item or fee is shown in a currency other than GBP sterling, the exchange rate used will give a guide figure only, it is not guaranteed. The exchange rates are gathered on a daily basis to give as accurate a figure as is possible. Invoices will be generated on site and not physically sent through the normal postal service.

Credit Limits.

Tazbar operates a credit limit system. All new members start with a £20($40USD :€30EUR) limit which is automatically increased as the user develops a good payment record. When a credit limit is reached users will be informed when they log in that they need to make a voluntary payment to release activity on their selling account. Limits start to increase after the first month of trading that has prompt payment.

Non payment of fees will lead to a member being suspended and action taken to collect the outstanding monies including any costs incurred.

Disclosure of personal information

As a person to person venue Tazbar must exchange some personal information. By joining Tazbar and accepting this user agreement you agree to allow your contact information to be made available to your trading partner. This will include, your email address, postal address, name and phone number. Your phone number will not be shared unless a trading partner makes a request for an exchange of numbers.

As you will receive other members contact information you agree to use this in relation to matters relating to the Tazbar transaction only. Such information must not be added to or sold on as mailing lists for Spam email or other such unsolicited activity. You should use this information in accordance with applicable laws including, without limitation, data protection and privacy laws. Further you must respect your trading partner and respond to their request should they ask you to remove their details from your records after a transaction is complete.

Closure of a user account.

Tazbar reserves the right to close a user's account at any time it sees fit if the user has breached this User Agreement or any of the policy or guidelines described throughout the website. The same will apply if a users contact details or registered credit/debit card are found to be false. Tazbar will make all reasonable efforts to warn users of infringements of rules through the official warning system. Tazbar also reserves the right to suspend a member without prior warning.

Any outstanding balance will be payable on account closure.

Disagreement with the User Agreement

If you disagree with any part of the User Agreement or any of the policy or guidelines described throughout the site please do not register.

Outage

Tazbar do not guarantee continuous uninterrupted service. This includes secure access. Whilst we will try to ensure that the site runs correctly to the best of our ability, there may be reasons for down time and interruption of services that are beyond our control.

Tazbar membership offers.

Tazbar or its associated companies may at times send, via your registered email address, offers of goods and services. There is no obligation to purchase or enter into an agreement to purchase the offer. Tazbar reserves the right to make the offers of goods or services available to its membership. By joining Tazbar you agree to this action.

Disputes.

Disputes that occur from use of the website fall into two categories:

1, Tazbar and its users.

Any disputes that occur between you and Tazbar in relation to it actions and services must be reported to us at policies@tazbar.net where they will receive the correct attention.

2, User to user disputes.

As previously mentioned Tazbar is simply a venue and does not get involved in its users disputes. Any such actions should be dealt with between the involved parties and if necessary you should report any such disputes to your local law enforcement agency.
Changes to fees, policies, categories and prohibited items.

When registering as a member of Tazbar you agree that changes can be made to any fees, policies, categories and prohibited items. Tazbar reserves the right to make any changes and will endeavor to post notification of these changes within the “News” section of the website. This section can be found by clicking “News” on the left hand toolbar. Please check the “News” page regularly for all announcements.


Fundraisers.

Registered fundraisers can list up to one hundred items at any one time but cannot exceed this amount or subscribe to level 1, 2 or 3 status. As items sell the registered fundraiser can add replacement items to take the total back up to one hundred listings.
Users placing items in the fundraising category register the same way as other users and agree to comply with the user terms for Tazbar. Tazbar takes it on trust that fundraising users are genuine and have the authority or permission to raise funds on behalf of their chosen cause. Fundraising users whether organisations or individuals have the same payment options open to them as general users and Tazbar will hold no special accounts nor be responsible for collecting or holding or distributing funds raised.

Tazbar cannot become involved in any dispute over distribution or use of funds raised through online auctions or Buy Now listings on the Tazbar website.
Registered fundraiser users are personally responsible for their own fees and payments to Tazbar and will incur the same fianancial communications and penalties for non payment or late payment of any seller fees due to Tazbar. Fundraisers incur the same seller fees as non fundraisers.

Tazbar reserves the right to make periodic checks with individual beneficiaries and beneficiary organisations that they are receiving funds raised in this program and any listings from non fundraisers will be removed for abusing the good intentions of this program and for trying to make gain over general sellers by listing items where the sale proceeds are not intended for fundraising or donations. Tazbar does not allow auction listings to raise profile and funds for political or lobby or extremist groups.

Items being listed must include the name of the beneficiary or beneficiary organisation included in the description and the reason for raising funds. If this does not happen then the item will be removed from the fundraiser program. Tazbar reserves the right to remove or move items which at its discretion do not appear to be for a genuine cause or items which are inappropriate or indecent or might cause offence.

Fundraisers are allowed to include a link to their own website that further explains and enhances their chosen fund. This website link can be present in in the space provided in sellers details. In listing descriptions and Seller Gallery profile pages. This link must not go to a website that offers services similar or the same as offered by Tazbar.com.
Tazbar reserve the right to contact fundraiser sellers directly to verify the individual or organization.

WARNING accepting the terms and conditions as an individual or on behalf of an organization is classed as an electronic signature and legally binds the user to all the terms and conditions of trading on Tazbar. This includes responsibility for paying fees incurred as outlined in the terms.

Disagreement with the User Agreement
If you disagree with any part of the User Agreement or any of the policy or guidelines described throughout the site please do not register.
